Real-Time Analytics (RTA)

1. Introduction

1.1 Context

Most Terms of Use and Privacy Policy documents are written by lawyers and for lawyers. Therefore,
terms are usually complicated and confusing. At Real-Time Analytics (RTA), we are committed to
serve with credibility, transparency, and efficiency. We want you, our customers, to understand the
data privacy issues involved when you are using the provided services. For that reason, we make our
terms as transparent as possible in both Vietnamese and English. This document is open for updates
and improvements over time.

Here are several definitions of terms that we use throughout the terms. When we mention “the service”, “the product,” “the platform” or specific names, we refer to the products made available
by Real-Time Analytics. Concrete product names, such as “rtWork,” “rtSurvey” and “rtHome,” are
clarified when needed. Furthermore, when you read “Real-Time Analytics,” “RTA,” “we – us,” or “our
company,” it refers to the official company we started in 2013 to develop and market our products.

We also want to clarify about  RTA’s  three different classes of customers: “Business User”, “Member
User” and “Individual User.” Business Users are the owners or leaders of an organization, business
or project. They decide to use one or both of our products rtWork and rtSurvey to manage,
facilitate and connect with their team members. Under those Business accounts, each team member who
uses RTA platforms is a Member User. Therefore, with rtWork and rtSurvey, RTA serves the Business
Users as our direct clients and Member Users as our indirect users. For rtHome platform, the
Individual User, who has full control of his or her own account, is the primary type of customers
we serve. We understand that it is our responsibility to protect the rights of all customers.
However, we do have different control and management for each user type. Please see below for
details.

This agreement only applies to Real-Time Analytics’ offered products. We do not take responsibility
for the products or platforms that we do not provide. If this agreement comes off as
unsatisfactory, please contact us or use other products supplied by other services!

1.2 Using The Service Means Accepting These Terms

By using, accessing the products and services in any way, whether as a Business, Member or
Individual User, or whether you are creating or obtaining any content from our servers, or you are
just browsing rooms as invited tester or guest from RTA or Business Users, you are agreed to and
bound by the all the terms of condition presented in this document and our Privacy Policy document.
Please note that violations of this document are subjected to legal responsibility and
investigation. If you disagree to any terms and conditions, please refrain from using and accessing
our products and platforms.

1.3 Updates Over Time

The “RTA Terms of Condition” is a living document, which means that we will update and improve the
terms under certain circumstances. We take users’ feedback and suggestion seriously if the proposed
changes apply to all RTA users. We do take cautious actions and update the terms and conditions
under modifications of domestic and international regulations. Therefore, we will likely improve
this document over time.

For transparency and credibility, we are committed to sending notices when we make improvements to
this document. By continuing to use the Service, you will implicitly accept the changes we make.
Your access and use of the Service is always subject to the most current version of this document.

1.4 Minimum Age Requirements

We require users to be at least 16 to use our service. We are committed to protect children’s
privacy and never collect or store information in the Service from those we know are under 16.
Please note that if our Business Users want to collect children information via our products, they
have to take action in protecting children’s rights. Thus, they will take the full responsibility
before national and international laws regard children privacy.

2. User Rights

2.1 Legal basis for processing and User rights

RTA processes your data under Legitimate Interest based on international laws of data
protection and individuals’ privacy such as General Data Protection Regulation (GDPR). This
means that we collect and process your data only for the purpose of providing services and
products, and in a manner that our users understand and expect. The processing of customer data we
undertake is necessary for the product delivery. We take careful consideration in this processing,
primarily to protect the listed rights in the section 2.1. We believe these caveats (discussed in
the section below in detail) are in line with the broader societal interests served by providing
the products.

In situations where conflicts between users and RTA arise, we will seek to reconcile those
differences guided by our policy.

2.2 User rights

2.2.1 Right to Erasure

The Right to Erasure is one of the most basic and essential rights a user has. For Business User,
you can request that we forget your account including all your Member Users by selecting the
options to remove your Business Users and Member Users or contacting us. What happens to your data
afterward depends on your actions such as storing or sharing, which are out of our control. In the
case of a Member User account, RTA can only erase your information when your Business User requests
and takes full responsibility for the process. You can certainly exercise your right to erasure if
you are an Individual User.

Any data that were only accessible by your account will be deleted from our servers within 30 days
after sending erasure confirmation. When you share contents with another user, both sides will have
access to their copy of those contents. In other words, even after we have processed your request
to be forgotten, shared data continue to exist in the common place. If this is not acceptable to
you, please do not use the Service.

2.2.2 Data Portability

Under the domestic and international legislation, you have a right to request a copy of your data in
a commonly-accepted format. If you are a Business User or an Individual User who want to have a
copy of your data, please send a request to support@rta.vn. If you are a Member User, please
request your copy directly from your Business User. We are currently working on a better interface
for your request.

2.2.3 Your Rights as RTA Data Subject

You have rights in relation to the personal data we hold about our users. Some of these only apply
in certain circumstances. Some of these rights are explored in more detail elsewhere in this
document. Here is a list of users’ rights from the domestic and international legislation:

The right to be informed

All users have the right to be informed about the collection and use of their personal data. As we
are committed to transparency, we set up concrete notice on users’ devices whenever the system or
the Business Users collect individuals’ information. This process is our priority in protecting the
customers’ right to be informed.

The right of access

All users have the right to access their data through their individual accounts. Please note that
Business Users can only collect private information such as locations and device information when
they obtain consent from Member User.

The right to rectification

All users have the right to have inaccurate personal data rectified, or completed if it is
incomplete. Please note that the customers are in charge of their information accuracy,
completeness, and efficacy.

The right to erasure

All users have the right to have personal data erased as specified in the section 2.1.2 above.

The right to restrict processing

All users have the right to request the restriction or suppression of their personal data. Please
note that our system automatically collects specific data under user’s allowance. In most cases,
the user can agree to provide or decline access whenever RTA system or Business Users demand. RTA
is working on data sharing reports for users and hopefully can share with our customers in the near
future.

The right to data portability

All users have the right to obtain and reuse their personal data for their own purposes across
different services. Agreement to transfer information allows RTA system to sync and store data
across platforms.

The right to object

All users always have the right to object to the processing of their personal data in certain
circumstances. In most cases, RTA system provides real-time notices whenever the data is being
collected, which means that users can choose to object at any time.

Rights in relation to automated decision making and profiling

All users have the right to control automated individual decision-making and profiling.

Please note that you can only exercise these rights when you are an official RTA user with an
associated account. We do not hold responsibility with other parties such as survey participants,
interviewees or guests. Notably, data and information of survey respondents belong to our clients
who use RTA service to collect and analyze data. The client decisions on what specific information
to obtain or how to process the data are out of our control.

3. Making a Complaint

We strive to protect users’ information to the highest level when collecting and using it.
Therefore, we take feedbacks and complaints from users very seriously. If you discover any problem
or dissatisfaction with our information collecting process, please let us know at support@rta.vn.
We are also in favor of any suggestion that you might have for us to make our services better.

4. Document History

This document was heavily inspired by Matrix.org’s Terms of Service document. As their document uses
plain English and specifies many terms that are similar to ours, we wanted to draw their rules and
adjust them to correspond with our own.
